By subscribing to or using any service offered by bySophia AI, operated by EA Creative LLC (DBA EA Creative Agency), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
These Terms apply to all clients, visitors, and users who access or use bySophia AI services at sophiavoiceai.com.
bySophia AI is a managed AI receptionist service. EA Creative LLC configures, operates, and maintains AI-powered voice agents on behalf of business clients using third-party infrastructure providers including Retell AI and Twilio. Our services include:
bySophia AI is a managed service, not a software license. EA Creative LLC acts as your service provider, not as a reseller of any underlying platform.
Services are offered under the following plans:
All plans include a one-time, non-refundable Setup Fee of $499 charged at the time of subscription. This fee covers initial configuration, agent training, and onboarding.
Prices are in U.S. dollars and are subject to change with 30 days' written notice to active subscribers.
Payments are processed securely through Stripe. By subscribing, you authorize EA Creative LLC to charge your payment method on a recurring basis (monthly or annually, depending on your selected plan).
Monthly plans: You may cancel at any time with no penalty. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days. The one-time setup fee is non-refundable regardless of when you cancel.
Annual plans — Satisfaction Guarantee: If you are not satisfied with the service within the first 30 days of your subscription start date, you are entitled to a full refund of your annual subscription fee upon written request to info@sophiavoiceai.com.
After 30 days, annual subscriptions are non-refundable. If you cancel an annual plan after the 30-day period, your service will remain active through the end of your paid term. No partial refunds will be issued for the remaining months.
The one-time Setup Fee of $499 is non-refundable under any circumstances, as it covers work already performed during configuration and onboarding.

bySophia AI services are designed to handle the typical inbound call volume of a local business of the size and type indicated at signup. Your plan includes the number of active voice lines specified (1 line for Starter, up to 3 lines for Pro).
Extraordinary usage — including but not limited to mass marketing campaigns, automated call flooding, or usage significantly above normal business patterns — is not included and may require an upgrade to a higher-tier plan or an additional usage fee. EA Creative LLC reserves the right to notify you and adjust your plan accordingly.
By using bySophia AI, you agree to:
EA Creative LLC will make reasonable efforts to ensure your AI receptionist is available at all times. However, we do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (including Retell AI or Twilio), or circumstances beyond our control may temporarily affect availability.
EA Creative LLC is not liable for any loss of business, missed calls, or damages resulting from service downtime.
All content, branding, and materials associated with bySophia AI — including the name, logo, website design, and service configurations — are the intellectual property of EA Creative LLC. You may not reproduce, distribute, or use them without prior written permission.
You retain ownership of any business information you provide to configure your AI agent (scripts, FAQs, business details). By providing this information, you grant EA Creative LLC a license to use it solely for the purpose of delivering your service.
bySophia AI services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
EA Creative LLC does not warrant that the AI voice agent will be error-free, that all calls will be handled without mistakes, or that the service will meet all of your specific business requirements.
To the fullest extent permitted by law, EA Creative LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, lost data, or business interruption — arising out of or related to your use of bySophia AI services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of these Terms or the services shall not exceed the total amount paid by you to EA Creative LLC in the three (3) months preceding the claim.
EA Creative LLC reserves the right to suspend or terminate your service immediately, without refund, if:
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Miami-Dade County, Florida, under the rules of the American Arbitration Association.
EA Creative LLC reserves the right to update these Terms of Service at any time. We will notify active subscribers of material changes via email at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
